The city of Ada took action last week that could result in a lawsuit against the company that built the Wintersmith Park Music and Movie Venue, over allegations that the completed facility did not meet the city’s specifications.
On Monday, the Ada City Council declared the Tulsa-based Timbrel Building Co. in default on its contract and authorized the city to sue the company, as well as anyone else who may be liable for damages. A lawsuit has not been filed yet, but the council has authorized one if necessary.
Declaring Timbrel in default and authorizing the lawsuit are the first steps toward fixing problems at the Music and Movie Venue so it can be used, said the city’s attorney, Frank Stout.
